Terms of Service

The short version
- · Use it for your parent group. Do not break it, and do not use it to harm anyone.
- · Your organization's data stays yours. Export it whenever; cancel whenever.
- · Paid products are billed once a year and cancel at the end of the term you paid for.
- · The documents this site writes are templates, not legal or financial advice. Have a human who is qualified look at your bylaws before you adopt them.

This agreement
These terms are between you and Talent Bottle, Inc., which operates PTO Kit. By using the site you agree to them. If you are agreeing on behalf of a PTO, PTA, booster club or other organization, you are confirming you are allowed to.
Who may use it
You must be 18 or older. PTO Kit is for adults running a parent group or working with one; it is not a service for children, and children should not create accounts or submit information here.
The free tools
The free tools need no account and are free with no catch and no expiry. They work by giving you a private link. Anyone holding that link can see and change what is behind it, so share it with care — we cannot tell an intended recipient from an unintended one.
They are provided as they are. We may change or retire a tool, and we will try to give you warning and a way to get your document out first.
What the generated documents are
Several tools produce real-looking documents: bylaws, a mini-grant policy, a budget, a sponsorship agreement, a handoff binder. They are starting points written from common practice, and they are not legal, tax or financial advice. Nobody here is your lawyer or your accountant.
Before you adopt bylaws, sign an agreement, or rely on anything here for a filing, have somebody qualified in your state read it. Your organization is responsible for what it adopts.
Accounts
You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has got into it. One person, one account — do not share a login around a board.
Paid products, billing and cancellation
- Paid products are sold to an organization on an annual subscription, at the price shown when you buy.
- Payment is taken by Stripe. You authorise the charge to recur each year until you cancel.
- Cancel any time. Cancelling stops the next renewal; the product keeps working until the end of the term you already paid for.
- We do not pro-rate part-years. If something has gone wrong, write to us — we would rather sort it out than argue about a refund policy.
- If we change a price, it applies from your next renewal and we will tell you before it does.
- If a payment fails and stays failed, the product stops being live for your teachers and families, but your data is still there and one payment brings it back.
Your data
Your organization owns what it puts in. We claim no ownership of it. You may export it while your account is open, and you may ask us to delete it at any time. We use it to run the product for you, not for anything else — see the privacy policy.
You are responsible for having the right to put in what you put in — particularly anything about a child, a family or a member of staff — and for telling those people, where telling them is the decent or the legally required thing to do.
Acceptable use
Do not use PTO Kit to break the law, harass anybody, upload malware, send bulk unsolicited email, misrepresent who you are, scrape the site, try to reach another organization's data, or resell the service as your own. Do not use it to collect information from children.
We may suspend an account that is doing any of that. Where we can, we will ask first.
What is ours
The site, the software, the writing and the design belong to Talent Bottle, Inc.. The documents a tool generates for you are yours to use, adapt, print and adopt, including commercially within your organization. You may not resell the tools themselves or pass them off as your own product.
Availability
We work to keep the service up and we do not promise it always will be. There is no uptime guarantee attached to a $39-a-year product, and we would rather say so than write one we cannot keep. Maintenance happens; we try to do it when school is asleep.
Warranties and liability
The service is provided “as is”, without warranties of any kind, to the fullest extent the law allows. In particular we do not warrant that a generated document is correct or sufficient for your situation.
To the fullest extent the law allows, Talent Bottle, Inc. is not liable for indirect, incidental or consequential losses, and our total liability for any claim is limited to what you paid us in the twelve months before it arose. If you paid us nothing, that figure is nothing — which is the honest trade for a free tool. Some places do not allow these limits, and where that is so, they do not apply to you.
Ending it
You may stop using the service or close your account whenever you like. We may end this agreement if you break these terms, or if we retire a product — in which case we will give you reasonable notice and a way to get your data out.
Changes
We may update these terms. The date at the top changes when we do, and we will email account holders about anything that materially affects them before it takes effect. Carrying on using the service after that means you accept the new version.
Governing law
These terms are governed by the laws of New Jersey, United States, without regard to conflict-of-law rules, and the courts there have jurisdiction.
